Work Permits, Post-Graduation Work Permits

Foreign students who complete a post-secondary program in Canada at a participating educational institution are entitled to obtain a work permit for a period up to 3 years, depending upon the length of their study program. For example, a person who completes a 3- or 4-year program of post-secondary study may obtain a work permit valid for up to 3 years. A person who takes an 8-month program is entitled to a work permit for 8 months only.

Off-Campus Work Permits

Foreign students are also entitled to obtain work permits allowing them to work off-campus, while they are studying, provided that they are enrolled at a participating educational institution for at least 6 months.

Spouses

Spouses of foreign students enrolled in participating educational institutions are entitled to obtain open work permits to work in Canada while their spouse is studying.

Permanent Immigration

Citizenship and Immigration Canada has announced that, commencing in the Fall of 2008, students who have worked in Canada for one year on a post-graduate work permit (referred to above) will be eligible to apply for Canadian permanent residence within Canada under the Canada Experience Class. They will not be required to file their application for permanent residence outside Canada and will not be required to meet the requirements of the skilled worker (point system) category. This is welcome news.

In addition, people who study in Canada obtain additional points towards the skilled worker program. If they work in Canada, they also obtain points towards the skilled worker program. This is in direct contrast to the US system, whereby a student who studies in the US must generally leave the USA after completion of studies. Moreover, there are very few opportunities for foreign students in the US to apply for US immigration even after they return to their home countries. Canada is welcoming students from abroad who want to study and thereafter becoming Canadian residents.
